Got A DUI & I've Been Sober For 2 years

paulieg, I am falling in love with you.

right. that's what people thought about the cheka, nkvd, gestapo, stasi etc... and then they came to your door. exaggeration? no, just taking this statist, pro-authoritarian argument to its logical conclusion. in the process of the immoral excercise of coercive force, the ends (a submissive populace exemplified by people like you) justify the means without regard for collateral damage. any day of the week, that collateral damage can be you and how rare that is depends solely on how far on the path towards complete and utter submission to immoral authority any given society is - cops can only afford not to carry guns when not enough people are willing to cause them grievous bodily harm.

You made my brain hurt. success. good post

You my lucky friend have had a sucky situation that could turn quite profitable with the right lawyer :)

Did you resist at all or were disrespectful to the cop? I'm trying to figure out the motive here. DUIs are usually a pain in the ass for cops to deal with so why would he inconvenience himself over this? Were you swerving on the road?

I didn't resist at all or give him any attitude. He did mention I swerved once but I really don't think I was swerving. I think that was a fake excuse for him to pull me over. Not sure why he would inconvenience himself over this he said I was his 3rd suspect of the night and that he gets to go home now.

You mentioned your headlight was out, did you happen to smash into anything before you got pulled over?

Also sounds like you were part of a DUI checkpoint or something. Hopefully they didn't get some other dude's piss in your cup.

I didn't smash into anything, I've never been in a car accident in my whole life. And, yeah I think it was a DUI checkpoint because I didn't actually go to jail and get my blood drawn I was taken to a parking lot filled with RV's where they were taking people's blood and piss. I'm really hoping my blood and piss is not tampered with.

Look at the article I linked to and the other articles linked to within it. Five Mesa cops were used to arrest one sober person. One of the officers when asked about quotas admitted that he likes to make 3 DUI arrests per day.

Interesting you say sounds like that cop that pulled me over is one of those cops. I remember over hearing the cop telling the other cops in the RV I was his 3rd suspect of the night and that he'd get to go home after he was finished with me.

While everybody is correct you won't go to jail if you're guilty, that's true. I have two DWI's and only had to do a weekend jail on my 2nd one and probation for 2 years for each but, after the 3rd one it gets serious. I learned my lesson and don't do it anymore but, the thing is that it is NOT just $2-$3k you'll end up spending like in Texas they teach you in the mandatory classes you have to take that after lawyer expenses, fees, surchages, restitution, etc. it's more like in the $20K range. I still remember that day in class, they ask each person in class how much they paid for their attorney, and they go through it all and tell you how much it will cost you, and they do some kind of comparison to tell you how much less expensive it would have been for you to take a cab instead of driving under the influence. I'm still paying monthly surcharges until August of next year for my DWI in 2008. Just my surcharges amount to almost $2,500 over the 3 years.

You definitely want to fight this if you're not guilty, it will be on your record and that's just the beginning, going through the shit they make you do is not fun, it's a lot of shit it's a lot of classes of all different kinds to "help" you, community service, monthly meetings with your probation officer, all kinds of fees to probation and restitution, in Texas you pay surcharges to the state for 3 years, shit load of paperwork, to me it was like having a part-time job, AA meetings (only had to on my 2nd but, could vary from state to state) it's pretty much designed to make you fail. Seriously somewhere down the line, you'll start wishing they just gave you jail time instead, some people do that end up exchanging jail time instead of completing probation.

If you really were sober, and he took your blood then I don't see how they can find you guilty, the proof is there in your blood. Of course contact an attorney asap but, it should be an easy case for them if you were really sober and they took your blood it's right there on paper that you weren't under the influence, plus they have cameras on the police cars, I didn't read did he make you do sobriety tests like do the alphabet backwards, or walk in a straight line etc. ? If you passed all that they can see the video, the judge and in court they can see that if you didn't look or act drunk that will count in your favor. My attorney wanted to see the video on my second DWI he said if I didn't look drunk they could maybe fight it but, he saw it and said fuck no lol there was no way i was way too wasted and looked it on the video, so had to plead guilty.

I did walk in a straight line, he shined his flashlight in my eyes multiple times. He said my pupils were doing weird things. And he kept making me redo the tests over and over. Not sure if there's a video of it, he was driving a motorcycle that night.

Sometimes the criminals will do this shit, and hope you pay it rather than show up in court and contest it.

It's Arizona. They charge a lot of people without any proof whatsoever. You don't necessarily need a lawyer, especially if you know you're right. Plead innocent and you will get off, they don't have a very good system here in AZ. They've tried to stick a few charges on me and I just plead innocent and they let me go. It's the people that plead for mercy that get fucked. You know you didn't do anything wrong.

No proof, no conviction.

Lawyer up and you'll be fine.

Also get an independent blood test done.

All in all, either you are leaving something out and are guilty as fuck OR you have 0 to fear.

Update.

OP went running that day, burned off some fat cells still containing alcohol from 2 years ago and is now cuddling with bubba.

Ugh Cops. Lets all share our oppressive cop stories!

I have been removed from my car in the rain, by force by 2 detectives in my town for sitting next to a "known cocaine dealer" at a highschool basketball game and "conversing" with him. Because we all know when I ask someone to scoot over on the bleachers a little so I can sit next to my girlfriend that I'm having a conversation. Then they proceeded to intimidate and harass my girlfriend into admitting that I deal cocaine and that I was at that basketball game to buy coke. After leaving my car doors open in a rain storm ruining my leather seats, and tearing everything out of my trunk, and damaging the dashboard/console they left me there in the rain. Soaking wet with a damaged car. To add insult to injury one of the cops handed my girlfriend a card and said "If you ever want to talk, just call me."

Fortunately that was his mistake, as we both sued the Police department. In lieu of monetary compensation for the damages to my vehicle, police harassment, police brutality (had bruises on my arm where they man-handled me) and other charges I brought against them I requested that the officers in question be fired and that their Texas law enforcement certifications be removed and that they not be allowed to practice law enforcement in the state of Texas for 15 years. Judge granted it. Guess he didn't want to cough up the $750k I was in damages I was looking for.

Two months later I see one of the 2 detectives working at the car wash I go to, scrubbing my rims just like the immigrants. I made sure to tell him about all the spots he missed then get his manager over and tell him that his employee was very combative when I corrected him on his horrible work. Justice served.

Get a lawyer bro, and a really good one. Take these fuckers and that asshole cop to the cleaners and when its all over be sure to tell them you don't want money. You want this "10 year veteran" shit-canned and working at the Mc Donald's drive through. Because he's not fit to "serve and protect" the fine citizens of Arizona.

Sure, and my attorney called me a dumbass directly. It wasn't about money, it was about vengeance, and I got all I could eat. :) Shit the other cop had to move to another state after his wife left him just to get another job. The "lead" detective was washing my wheels. No amount of money can buy that kind of happiness.

With that said the police department here has had a long history of harassing me for various things they thought I was doing, or suspected I was doing. After that case I can't even get a speeding ticket in this town for doing 80 in a 60. True story.

"I caught you doing 80 in a 60, is there a reason for that?"

"No, just in a hurry"

"License and registration please"

"ok"

Goes to his car .... comes back....

"Have a nice day, please slow it down"

"Thanks officer"

<traction control off> spin tires throwing rocks at the cop car as I proceed to re-merge onto the freeway. My name is in their system under "Do not fuck with" somewhere now I'm sure of it.
