Got A DUI & I've Been Sober For 2 years



I don't understand if they were charging you with a DWI you would have gone to jail, if you failed the breathalyzer, he would have handcuffed you and taken you to get you processed, you would go to jail and you would have to bond out.

"He didn't tell me what the breathalyzer said. & on this paper the cop gave me it said not to contact the hospital for the results because they won't have them. So I'm guessing they're testing my blood and piss in house with their own lab. They say it's going to take roughly 30 days to get the results. "

What the hell is that? Did he take you to jail and arrest you and formally charge you with the DWI? Or did you just get tickets for something that you don't understand what it is? They don't just take your breath tests, blood, etc. tell you we'll see you in 30 days, go back to their lab and let you go like that.

If there's suspicion of a DWI and you're pulled over, that's it. You are going to jail right then and there. They'll ask you to do sobriety tests, I forgot it's been a while but, pretty sure you can refuse breathlyzier, I don't remember about blood or not but, some people say since it takes time to get to the jail that you could start sobering up during that time or get lower results, so some people do that. If you fail any of the tests right then and there, that's it, you're going to jail. Even if they take your blood they don't wait for results to return, you still go to jail, get charged processed, have to get bonded out etc.

Anyway the point is either you got charged or you didn't, they aren't off with your test results and waiting to get back to you on it. That doesn't happen with DWI's.

In Nevada it's up the cop if you get breath or not. Most of the time they will ask you to blow and tell you that you can refuse. What they don't tell you is they then force you to draw blood. If you object to that you'll have 5 people old you down while they do it regardless. Once you refuse the breath test and find out they'll draw blood anyway the breath test is off the table. I think they get off on it or something. Why else wouldn't you tell people what happens if they don't blow instead of just saying sure you don't have too.
 
Mesa AZ is horrible. The sheriff's daughter was killed by a drunk driver a few years ago. I hear they write DUIs for anyone that measures ANY amount of alcohol in their system. Call Aaron Kelly (Kelly Law Firm), he is a lawyer in Scottsdale and a member of this forum.

The cop took me to a parking lot filled with RV's where they were doing the blood testing, instead of taking me to jail. I'm not sure why I didn't go to jail but that's where they took me and they towed my car and I had to have my mom pick me up from there. I have a court date for January 12th 2012 and on the ticket it says 1. Driving with two head lights at night is needed (1 headlight was out) 2. DUI 3. DUI drugs

When it comes to the amount of alcohol in me it had to be 0 because I don't drink and haven't had a drink in the past 2 years. Nor do I smoke or take prescription drugs.

I'm still worried though, because I've obviously been setup by that cop and I don't want to somehow end up in jail over this. But yeah, as long as my blood and piss aren't tampered with I'm hoping the charges will be dropped
 
Dude at least tell us you swished with listerine or something before driving.

I'm sorry, but something doesnt add up. If you were really 100% sober then they cant do shit.
 
PS. Even if you some how you end up guilty, you won't get jail time.

You'd be looking at $2-3k in fines and some community service like freeway trash pickup or something.

Because ALL they want from you is some money. They don't have the jail space or the resources to throw away on you.

They want you to pick up trash for free and pay them.

If there was even a .0000001% chance of you getting even 30 minutes in a cell I'd tell you, but trust me your not going to spend any time in jail at all.

Not sure how AZ works, but in most states first DUI is a simple misdemeanor. So even if it is on your record you won't ever have to report having a felony. Also, you can generally get something like that sealed.
 
Okay, I just read through all the OPs posts, and I'm still confused. How the fuck are they saying you were drunk with no proof. I've NEVER EVER heard of a DUI case where it was the cops word vs the defendent. There has to be proof, in other words your BAC (Blood Alcohol Content).

This doesn't make any sense.

Any half ass attorney would get this thrown out if it really is as you say it is. Never heard of a case like this. I'm fuckin confused.

I'm confused too, at first the cop was accusing me of being drunk. Then he accused me of being high. & he kept telling me he's been a cop for 10 years and he knew I was "lying". On a ticket does it usually say the alleged Blood Alcohol Content? Because on my ticket it doesn't have a BAC written down.
