Got A DUI & I've Been Sober For 2 years

Hold up, do you HAVE to give them blood and urine? Is this law? I thought the only thing you are required to do is breathalyzer????!! With the option for blood test if requested... I would tell that cop to suck a fat dick trying to stick a needle in my arm, and then demand my lawyer present.

Start writing down everything that happened and what he said. He sounds like a prick. Make him look like the psychopath he is.

O and find out if the judge is Mormon before you get to court. If it goes to court.
 
Any lawyer would love to take on a case like this. Here in Alabama if you refuse a BA test you get a night in jail and have to make bond. At court your license in automatically suspended for 90 days. It's listed as a refusal on your driving record. Same outcome as if you did blow over the limit.
 
Not sure how AZ works, but in most states first DUI is a simple misdemeanor. So even if it is on your record you won't ever have to report having a felony. Also, you can generally get something like that sealed.

It still gets reported for Insurance.
 
I'm confused too, at first the cop was accusing me of being drunk. Then he accused me of being high. & he kept telling me he's been a cop for 10 years and he knew I was "lying". On a ticket does it usually say the alleged Blood Alcohol Content? Because on my ticket it doesn't have a BAC written down.

Hm, I've never gotten a DUI, so I can't tell you for sure. But there would definitely be some sort of document that would state your BAC.

Even though I hate lawyers, they are the only people who can really help you at this point. Look around and read reviews before picking out a lawyer. I'll tell you this; 99% of lawyers want nothing more than your money. But there are a good 1% who truly care about their clients. You have the internet right in front of you, so do your research. Definitely consult with a couple of lawyers at least (some will be free, others will charge you).

Keep in mind, I'm writing this post assuming that you had no alcohol in you, and this is just stupidity on the part of the police department. If there is no proof that you were under the influence, you will be fine (with an attorney).

And also, be up front with the attorney. The more up front you are, the easier they can help you.

Btw, I noticed earlier that you asked if you would be reimbursed for any costs incured (legal fees). Legally, yes, you could recover those costs, but chances are, it won't happen. You'll have to spend money to hire a lawyer for a civil case, and it probably wouldn't be worth your time and money.

And that cop sounds like a fuckin dick head.
 
As others have said, no you won't end up in jail for a first DUI at least not here in Wisconsin, I have a friend who's had a couple. First one was just a night in jail and a couple thousand dollar fine. After that you start serving time. I think his second he had to serve like 6 months probably more so because he crashed his car in to a guard rail and left the scene. You get a nice hefty fine though. Lawyer up, it's going to be cheaper than the alternative in case things do go sideways.
 
Did you resist at all or were disrespectful to the cop? I'm trying to figure out the motive here. DUIs are usually a pain in the ass for cops to deal with so why would he inconvenience himself over this? Were you swerving on the road?
 
A lot of cops are sociopaths, enforcing laws they do not understand and cannot justify.

The idea that the cop needs a motive to be a dangerous lunatic is funny to say the least.

Yeah well that's the cop-out (pardon the pun). "Cops are just assholes so I'm expected to believe this story" doesn't really ride with me.
 
You mentioned your headlight was out, did you happen to smash into anything before you got pulled over?

Also sounds like you were part of a DUI checkpoint or something. Hopefully they didn't get some other dude's piss in your cup.
 
to the OP, I'm a lawyer and in Arizona. I can refer you to some great criminal attorneys in the area. Also, have you been dry or sober? Do you go to meetings? Do you have a sponsor?

While I don't want to get into bashing, I will say that I have heard of Mesa police doing similar things, as well as other cops in the area. I've noticed DUI patrols out in full force the past 2 weeks.

I haven't drank/drugged in 3.5 years and when I've gotten pulled over that's usually the first thing they ask, I just show them my 3 year coin and they leave me alone. Plus I'm a lawyer.

So anyway, hit me up on skype aaronkellylaw and I'll give you some numbers. Plus the fact you're another gay webmaster in Arizona is nice to know, since there's a lot of us.

WTF!? A cop gave me a DUI in Mesa, Arizona on Thursday night and I was completely sober and haven't drank or smoked weed in the past 2 years and I'm on no prescription medication or anything like that. Now I face going to jail for 30 days and pay thousands in fines. What the fuck should I do?

I'm not going to read this whole thread to catch up, because if you can't post the whole story properly in the first post of the thread, you can fuck right off.

Look at the article I linked to and the other articles linked to within it. Five Mesa cops were used to arrest one sober person. One of the officers when asked about quotas admitted that he likes to make 3 DUI arrests per day.
 
While everybody is correct you won't go to jail if you're guilty, that's true. I have two DWI's and only had to do a weekend jail on my 2nd one and probation for 2 years for each but, after the 3rd one it gets serious. I learned my lesson and don't do it anymore but, the thing is that it is NOT just $2-$3k you'll end up spending like in Texas they teach you in the mandatory classes you have to take that after lawyer expenses, fees, surchages, restitution, etc. it's more like in the $20K range. I still remember that day in class, they ask each person in class how much they paid for their attorney, and they go through it all and tell you how much it will cost you, and they do some kind of comparison to tell you how much less expensive it would have been for you to take a cab instead of driving under the influence. I'm still paying monthly surcharges until August of next year for my DWI in 2008. Just my surcharges amount to almost $2,500 over the 3 years.

You definitely want to fight this if you're not guilty, it will be on your record and that's just the beginning, going through the shit they make you do is not fun, it's a lot of shit it's a lot of classes of all different kinds to "help" you, community service, monthly meetings with your probation officer, all kinds of fees to probation and restitution, in Texas you pay surcharges to the state for 3 years, shit load of paperwork, to me it was like having a part-time job, AA meetings (only had to on my 2nd but, could vary from state to state) it's pretty much designed to make you fail. Seriously somewhere down the line, you'll start wishing they just gave you jail time instead, some people do that end up exchanging jail time instead of completing probation.

If you really were sober, and he took your blood then I don't see how they can find you guilty, the proof is there in your blood. Of course contact an attorney asap but, it should be an easy case for them if you were really sober and they took your blood it's right there on paper that you weren't under the influence, plus they have cameras on the police cars, I didn't read did he make you do sobriety tests like do the alphabet backwards, or walk in a straight line etc. ? If you passed all that they can see the video, the judge and in court they can see that if you didn't look or act drunk that will count in your favor. My attorney wanted to see the video on my second DWI he said if I didn't look drunk they could maybe fight it but, he saw it and said fuck no lol there was no way i was way too wasted and looked it on the video, so had to plead guilty.

this. there are some cops who get into it for the benefits and the pension (whores of authoritarianism), but the majority just get off on the power trip that goes with the badge and the chance to behave sociopathically with the full backing of 'the law'
