Okay, but going by the assumption that you're NOT smoking weed in your car, and the officer is just fabricating that to fuck you over for no reason/cos he didn't like your attitude/cos he's powertripping/whatever motivation he would have to do so... So it's his word against yours, he says he smelled smoke, there was no smoke.. You're in court, do you think that it really matters how far down your window was rolled? That's what I was trying to say.
If you can document that you didn't roll your window down far enough and didn't create
a draft to push it out of the opened window (video camera) then it will greatly help your
case. That's why cops don't like you video taping them... so you can't use it against them.
On the other hand, if you ARE smoking weed in your car or you reek like booze, I can see why you would only want to roll the window down an inch. If you're not drinking or smoking while driving your car, though, I really don't see what you stand to gain by only rolling your window down an inch like the guys in the video who (I'll assume) weren't drunk or stoned.

Bottom line is that the police are not your pals or buddies. The more you converse
with and do whatever they tell you to do the longer your rope gets to hang yourself.
True story:
Last summer I was coming home from a bar and got stopped for a burned out headlight...
(Not swerving or driving like a drunk person)
I gladly opened my window all the way down and barked answers, like a good little sheep, at every question asked...
Cop: Where are you going?
Me: Home
Cop: What were you doing?
Me: Dropping some friends off.
Cop: Where did all of you go tonight?
Me: We went to [name of the bar]
Before I could speak another word:
(Totally changed tone)
I SMELL ALCOHOL ON YOUR BREATH... GET OUT OF THE VEHICLE!
So I started laughing and got out... about 15 minutes later and all the drunk tests he
could think of he says "
Well, you're pretty alert for someone that's been drinking all night!"
My response:
I was the designated driver
I didn't have a single drop of alcohol that night... So he lied about smelling it.
Now would have rolling my window down only an inch stopped my sobriety test?
Maybe not... But the police are not your friends. They'll use anything and everything
against you to try to fuck you over to get your money and freedom from you.
No reason to make it easy for them...
